The use of mobile devices is ubiquitous. Smartphones, tablets, and laptops have become indispensable tools in our daily lives.
However, the unique nature of mobile device data raises complex issues that are not often raised or addressed in sufficient detail by the courts to provide parties and practitioners with a clear legal framework for meeting their discovery obligations related to mobile device data.
Accordingly, The Sedona Conference “Commentary on Discovery of Mobile Device Data” provides both legal and practical guidance to parties, counsel, and the courts on relevant standards and factors impacting discovery of mobile device data, while addressing evolving technical issues affecting this type of data. To this end, it provides guidance for preserving, collecting, processing, searching, reviewing, and producing mobile device data.
This Commentary is a project of The Sedona Conference Working Group 1 (WG1) on Electronic Document Retention and Production. The public comment period for this paper ends July 3.
