The risk of liability for a data breach seems to be rising exponentially in 2013. With near daily reports of sophisticated attacks against corporate and governmental systems, millions of records that contain highly confidential information are in danger of being compromised. Now, more than ever, organizations face new and critically important questions of how to defend themselves against these attacks and how to mitigate their risk in order to manage, store, and protect sensitive information.

With this conference, Sedona will explore the creation of a Working Group to define a framework of Best Practices in data breach cases. We need the best practitioners to begin to address the evolving questions in this critically important new area of the law!

Faculty co-chairs are Tina Ayiotis, Professor of Information Policy at George Washington University, former Deputy General Counsel at Computer Sciences Corporation and previous leader of Booz Allen Hamilton’s Integrated Records and Information Management Program; and Amor Esteban, partner in the Data Security and Privacy Practice group at Shook, Hardy & Bacon and chair of The Sedona Conference® Working Group 6 of Cross-Border Discovery and Data Protection.

The co-chairs pulled together an extraordinary faculty of judges, government officials, industry leaders and attorneys including in-house counsel from HSBC Securities, UBS AG, Zurich Financial Memorial Healthcare Systems, and Reed Elsevier.

Among high profile faculty names are:

  • Hon. Ursula Ungaro, U.S. District Court Judge for the Southern District of Florida, who presided over a recently-settled high profile data breach class action
  • Hon. Mitch Dembin, U.S. Magistrate Judge for the Southern District of California, former Cybercrime Coordinator for the Office of U.S. Attorney and Chief Security Advisor for Microsoft Corporation
  • Hon. John M. Facciola, U.S. Magistrate Judge for the District of Columbia and author of several opinions addressing data protection, surveillance, and Fourth Amendment considerations
  • Kimberly Peretti, Former Justice Department prosecutor and lead counsel in the largest hacking and identify theft case ever prosecuted by the department- the trial of the infamous TJX hacker Albert Gonzalez; Currently Partner in the White Collar Crime Group and Co-Chair of the Security Incident Management and Response Team-Alston & Bird

These and other highly accomplished industry professionals will engage in a Sedona-style dialogue to explore critical issues such as:

  • The current state of the law regarding data security and cyber privacy
  • Responding to data breach incidents
  • Strategies in civil litigation involving data breaches
  • Regulatory responses to data breach incidents
  • Protecting valuable intellectual property in a global cyber environment
  • Data protection and security for lawyers and law firms
  • Options for responding to hacking attacks by foreign corporations and/or governments

In addition, there will be breakout sessions addressing the specific data breach issues involving these industry groups:

  • High Tech, Telecommunications and Energy
  • Healthcare, Pharma and Biotech
  • Financial Services
