TAR Case Law Primer


The Sedona Conference's Working Group 1 has just published a comprehensive review of court decisions addressing the use of Technology-Assisted Review (TAR) in civil discovery from 2012 through 2016. The Primer may be download free of charge here. It discusses more than 35 decisions from state, federal, and foreign courts and administrative agencies, touching on - among other issues - whether a responding party may use TAR over the objection of a requesting party, if and when a court can compel a party to use TAR, whether parties are required to disclose or negotiate TAR methodologies, and the relationship between TAR and traditional methods of document culling and review.

The Primer is the result of careful review and analysis by a diverse team of Working Group 1 members, was recently updated in response to public comment, and is designed to be an introduction and guide to the use of TAR in civil litigation and government investigations, without passing judgment on the efficacy of particular TAR applications or methodologies. We are pleased to be able to release this "final" version, which we anticipate will be updated as the case law continues to develop.

The webinar is scheduled for 90 minutes, during which time you may text your questions to the panel, who will endeavor to address all that time allows.
