Welcome to the first quarterly update of the Sedona Conference Working Group 12 on Trade Secrets!
To facilitate community and engagement of people who practice trade secret law, we plan to send one email every quarter updating our volunteers and others on WG12 work, activities, and opportunities. As you can see below, WG12 is busy with meetings, drafting teams, and brainstorming groups, so there’s lots of ways to get and stay involved.
Registration Open for WG12 Annual Meeting

WG12 at Sedona’s Global IP Litigation Conference
WG12 has a panel at this year’s Global IP Conference on International Trade Secret Litigation. The conference is March 24-25, 2025, at the Hilton The Hague in The Hague, Netherlands. If you’d like to learn more about the conference or register for it, click here.
New Drafting Team
WG12 has approved a new drafting team: Exemplary Damages and Attorneys’ Fees. The team is currently accepting applications from volunteers who want to participate. If you’d like to apply to participate on this drafting team, please do so here by February 19, 2025.
Current Drafting Teams and Upcoming Publications
WG12 has more than 50 members hard at work on five drafting teams, all advancing the public comment versions of their commentaries. We expect to publish each of these before the Annual Meeting in October, including the first one later this month: The Use of Clean Rooms in Managing Trade Secret Litigation Risk. Keep an eye out for the eBlast announcing the publication of this public comment version on Sedona’s website. Here are our other drafting teams:

- Forensic Issues in Trade Secret Disputes
- Sharing Trade Secrets with Other Organizations
- Protecting Trade Secrets and Confidential Information Through Contract
Current Brainstorming Teams
WG12 approved four new brainstorming teams in the last few months, and there are currently more than 45 members across these teams working on charters that they will present at the Annual Meeting in October. Here are the four new teams:
- International Trade Secret Enforcement and Protection
- Developing an Effective “Incident Response Plan” When Trade Secret Disputes Begin
- Trade Secret Guidance for Employees Who Change Jobs
- When Continued Possession of Trade Secrets Post-Separation Does or Does Not Constitute Misappropriation of Trade Secrets
