Mobile devices are ubiquitous, and are increasingly the primary device through which parties communicate, including company employees conducting business. As a result, it is increasingly likely that mobile devices will be at least a potentially relevant data source to consider in most litigation. But the discovery of mobile device data can present certain legal considerations and technical challenges with respect to scope, preservation, collection, search, and production. The Sedona Conference Working Group 1 has sought to address these considerations and challenges in its consensus-based Commentary on Discovery of Mobile Device Data.
This Commentary is intended to provide organizations, lawyers, and the judiciary with foundational information regarding mobile devices, and guidance on how to address the legal issues and technical challenges that are likely to arise regarding the discovery of mobile device data.
