Webinar on The Sedona Conference Working Group 9 Commentary on Patent Damages and Remedies

In one month, a distinguished panel will discuss the seminal Sedona Working Group 9 (WG9) Commentary on Patent Damages and Remedies that was published for public comment in June 2014, proposing solutions to hotly contested issues in this area. The most significant departure from the current “reasonable royalty” framework is WG9’s proposed “Retrospective Model” for reasonable royalty damages, under which the hypothetical negotiation takes place at the time of trial and allows for consideration of all relevant facts and circumstances occurring up to the time of trial. The Commentary also provides practical guidance for those involved in the nuts and bolts of patent damages litigation.

Topics to be covered in the webinar include:

Principles defining what should and should not be considered in calculating the reasonable royalty.
A proposed heightened damages disclosure requirement of preliminary compensatory damages contentions.
A dialogue on WG9’s proposed Retrospective Model for reasonable royalty damages.

We continue to invite public comment to the WG9 Commentary. All comments received by Friday, October 17 will be fully considered leading up to and during the All Voices Meeting. The deadline for public comments is Friday, January 30, 2015, after which all comments will be fully considered and incorporated as appropriate into the Commentary to be published in post-public comment form in early to mid-2015.

The WG9 Commentary will also be the focus of the dialogue during a panel during The Sedona Conference’s upcoming “All Voices” Meeting. For the first time all of the active Sedona Conference Working Groups will be convening at the same time and place to hold their annual meetings and present educational programs, including approximately 12 hours of programming on cutting-edge issues in patent litigation.

The Public Comment Process for the Commentary on Patent Damages and Remedies

We continue to invite public comment to the WG9 Commentary. All comments received by Friday, October 17 will be fully considered leading up to and during the All Voices Meeting. The deadline for public comments is Friday, January 30, 2015, after which all comments will be fully considered and incorporated as appropriate into the Commentary to be published in post-public comment form in early to mid-2015.
