For several years, The Sedona Conference has provided an intensive, two-day immersion training program in eDiscovery negotiation for a small, select group of practitioners, led by a stellar faculty of veteran trial lawyers, eDiscovery experts, and judges. This year, for the first time, we are also offering an introduction to the concepts and methods of eDiscovery negotiation – and an assessment after seven years of training programs – in a 90-minute webinar open to the entire legal community.
The webinar will be led by retired Florida judge Ralph Artigliere, who will be joined by U.S. District Judge Paul Grimm, author of the famous Mancia v. Mayflower decision, and Senior Judge Joseph C. Iannazzone of the State Courts of Georgia. During this webinar, Judge Artigliere will ask Judges Grimm and Iannazzone their views on the role of cooperation and negotiation in civil litigation, the ethical and rule-based requirements for cooperation, the tension between cooperation and historic concepts of “zealous advocacy,” strategies for dealing with uncooperative opponents, the role of the judge in encouraging cooperation between counsel, and the effect of recent amendments to federal and state Rules of Civil Procedure. The Sedona Conference’s eDiscovery Negotiation Training: Practical Cooperative Strategies is an outgrowth of the Sedona Conference’s Cooperation Proclamation, a call for parties, counsel, and courts to work together to reduce the cost and delay of civil litigation, consistent with Rule 1 of the Federal Rules of Civil Procedure and the ethical obligations of attorneys as officers of the court. Since 2008, more than 200 judges have formally endorsed the Proclamation, scores of law review articles and court decisions have cited it, and it has been incorporated into countless pretrial and standing orders. The Proclamation differed from prior appeals for civility in the legal profession because it contained a call to action -- a call to put civility into practice. Central to fulfilling this mission is providing training for lawyers, regardless of how few or how many years of experience they may have as litigators, in negotiation skills applied to discovery and related pretrial procedures.
