Webinar on The Sedona Conference Primer on Managing Electronic Discovery in Small Cases, Public Comment Version

For years, members of The Sedona Conference Working Group 1 on Electronic Document Retention and Production (WG1) have suggested the need for a publication dedicated to electronic discovery best practices tailored for "small cases" -- matters involving small quantities or less-complex varieties of electronically stored information or in which the smaller stakes involved significantly limit the time and money that realistically can or should be spent on electronic discovery. The task proved challenging and time-consuming for a variety of reasons, including the huge volume and variety of small cases and the difficulty in arriving at common-sense approaches that can be applied uniformly. At long last, in December 2022, WG1 published The Sedona Conference Primer on Managing Electronic Discovery in Small Cases, Public Comment Version -- available here for free download.

Driven by the overarching principle of proportionality -- tailoring eDiscovery to fit the particular circumstances of the cases and the resources at hand -- some guidance in the Primer may justifiably diverge from what The Sedona Conference recommends for larger, more complex cases. But just as in larger cases, the Primer emphasizes the central role of cooperation between the parties in effectively and efficiently managing discovery in small cases.  The Primer also identifies examples of some low- or no-cost tools and technologies that can help meet small-case needs on a tight budget.

Members of the Primer's drafting team will present key takeaways and solicit feedback and questions in a webinar on Wednesday, February 8, at 3:30 p.m. EST.
